By accessing this website and registering as a Dubai Property Network Agent, you agree to these Terms and Conditions, which include provisions governing the Affiliate Referral Programme in which all Agents can participate.

1. About the Website

• This Website is operated by Dubai Property Network (“we,” “our,” “us”), based in Dubai, UAE.
• The Website provides property information, downloadable materials, and access to support from the Dubai team.
• Access to the Agent Portal is restricted to registered users, including partner agents.

2. User Registration

• By registering, you confirm all information is accurate and you will keep login credentials confidential.
• We may suspend or terminate access if misuse or violations of these Terms occur.

3. Use of the Website

• Permitted Use:
  • Viewing property details, brochures, and floorplans.
  • Requesting support or sales forms.
  • Accessing the Affiliate Portal

• Prohibited Use:
  • Misuse of resources, unauthorized marketing, spamming, fraudulent activity, or illegal behavior.

4. Content and Accuracy

• Information is provided by third-party developers and may change without notice.
• All content is “as is”; we do not guarantee accuracy, completeness, or reliability.

5. Intellectual Property

• All Website content, including text, graphics, logos and documents, is owned by Dubai Property Network or content providers.
• You may share property information with clients solely to facilitate property sales.
• Unauthorized use may result in termination of access or legal action.

6. Agent-Specific Terms

(Applies to all registered partner agents, including participation in the Affiliate Referral Programme)

6.1 Purpose

• Agents promote and sell Dubai Property Network properties in Dubai.
• Agents also participate in the Affiliate Programme to generate referrals and earn commissions.

6.2 Relationship

• Agents are independent contractors.
• No joint venture, agency, or employment relationship is created.
• Agents cannot bind Dubai Property Network legally or financially.

6.3 Scope of Work

• Agents may introduce clients globally.
• Dubai Property Network manages clients from the unit selection stage, supporting earlier if requested.
• Agents may generate referrals via unique links, codes, or approved marketing materials.
• A valid referral is a new client who completes required actions (see 6.4).

6.4 Commissions and Compensation

• Commission Types:
  • Referral Commission: 30% of Dubai Property Network’s Net Income for clients introduced who successfully complete a purchase.
  • Introduced Sales Commission: 50% of Dubai Property Network’s Net Income for clients introduced at the unit selection stage.

• Definition of Net Income:
  • The total commission received by Dubai Property Network from the developer, after deducting sales-related costs.

• Conditions for Sale to Qualify:
  • The client must complete all payment milestones:
    • Down Payment paid
    • DLD (Dubai Land Department) payment completed
    • Sale and Purchase Agreement (SPA) signed
    • Any applicable installment(s) paid and cleared in the bank account
  • If any of these conditions are not met (e.g., client refuses to sign SPA or cancel the deal), no commission is payable.

• Payment Process:
  • Dubai Property Network provides written confirmation of commission for each completed sale.
  • Agents must submit an invoice for the approved amount.
  • Payment is made by bank transfer within 3 business days of receiving the developer’s payment and the Agent’s invoice.
  • Currency conversion or transfer fees are borne by the Agent.

• Refunds / Cancellations:
  • Commissions are void if the client cancels, defaults, or otherwise fails to meet the sale conditions.

6.5 Agent Responsibilities

• Represent yourself professionally and comply with relevant laws.
• Maintain confidentiality of client information and business operations.
• Do not use Dubai Property Network branding or logos without prior written consent.
• Comply with Affiliate Programme rules: no spam, misleading claims, or unauthorized marketing.

6.6 Term and Termination

• Agreement effective upon registration.
• Either party may terminate at any time; no notice required.
• Commissions on in-progress sales or valid referrals at termination remain payable according to the terms above.

6.7 Taxes

• Agents are responsible for all taxes arising from commission or income.
• Dubai Property Network will not withhold or pay taxes on behalf of Agents.

7. Disclaimers and Limitation of Liability

• We do not guarantee Website availability, accuracy, or completeness.
• To the fullest extent permitted by law, Dubai Property Network disclaims liability for any loss, damage, or inconvenience from Website use or Agent/Referral activities.

8.  Termination of Use

• We may suspend or terminate your access for violations of these Terms or prohibited activities.

9. Governing Law and Jurisdiction

• These Terms, including Agent and Affiliate-specific terms, are governed by UAE law.
• All disputes will be resolved exclusively in the courts of Dubai.

10. Changes to Terms

• We may update these Terms to reflect operational or legal changes.
• Users and Agents will be notified by email. Continued use after notification indicates acceptance.
